TERMS OF SERVICE

  1. ABOUT THESE TERMS

These Terms of Service apply to your use of the De Nieuwe Markt website and to all orders placed through our online store.

De Nieuwe Markt is operated by De Ploeg Retail B.V. In these Terms, “De Nieuwe Markt”, “we”, “us” and “our” refer to De Ploeg Retail B.V., trading as De Nieuwe Markt.

By placing an order through our online store, you agree to these Terms and to the policies referred to in them, including our Return and Refund Policy, Shipping Policy and Privacy Policy.

Mandatory consumer rights under Dutch and European law always take precedence over any conflicting provision in these Terms.

  1. ABOUT DE NIEUWE MARKT

De Nieuwe Markt is a curated retail store offering new and pre-loved clothing, accessories, art, prints, books, magazines, design objects and products made by independent artists and makers.

Some products are unique, handmade, vintage, pre-loved, limited-edition or sold on consignment on behalf of an artist, maker or other supplier. Unless clearly stated otherwise, your purchase agreement is always concluded with De Ploeg Retail B.V. and we remain responsible for fulfilling the order and handling customer service.

  1. ACCESS AND ACCOUNTS

You may browse our website without creating an account. If you create an account, you are responsible for providing accurate and current information and for keeping your login details secure.

You must not share, sell or transfer your account. Please contact us immediately if you believe that somebody has gained unauthorised access to it.

You must be legally capable of entering into an agreement. If you are under the age of 18, you may only place an order with permission from a parent or legal guardian where that permission is legally required.

  1. PRODUCT INFORMATION

We make reasonable efforts to describe and photograph every product accurately. Product photographs, colours and proportions may appear differently depending on your screen, device settings, lighting and display configuration.

Measurements are approximate unless expressly stated otherwise.

Because part of our collection consists of vintage, pre-loved, handmade, artist-made and one-of-a-kind products:

  • pre-loved and vintage items may show signs of age, previous use or wear;

  • handmade items may contain minor variations in colour, shape, finish, texture or dimensions;

  • artworks and prints may differ slightly between editions;

  • packaging may vary; and

  • many products cannot be replaced with an identical item once sold.

Relevant signs of wear, damage, imperfections or variations known to us will be described or shown where reasonably possible. Characteristics that were clearly disclosed before purchase are considered part of the agreed condition of the product.

A product being vintage, pre-loved, handmade or sold on consignment does not reduce your statutory consumer rights.

  1. AVAILABILITY

Many products offered by De Nieuwe Markt are unique or available in limited quantities. Adding a product to your basket does not reserve it.

Although we take care to keep stock information accurate, an item may occasionally become unavailable due to a stock discrepancy, simultaneous in-store sale, technical error or damage discovered during fulfilment.

If an ordered product is unavailable, we will contact you as soon as possible. You may choose an available alternative where appropriate or receive a full refund for the unavailable item.

We may limit the quantity of a product that one customer can purchase when this is reasonably necessary to protect availability or prevent unauthorised resale.

  1. PRICES AND TAXES

All prices are displayed in euros and include applicable VAT unless clearly stated otherwise.

Delivery charges and any other mandatory costs are shown before you submit your order.

Prices may change at any time, but a price change will not affect an order that we have already accepted.

For deliveries outside the European Union, local import duties, taxes, customs charges or handling fees may apply. Unless checkout expressly states that these charges have been prepaid, they are normally collected by the destination country or carrier and are the customer’s responsibility.

  1. ORDERS AND FORMATION OF THE AGREEMENT

By submitting an order, you make an offer to purchase the products in your basket.

After placing an order, you will receive an electronic confirmation. The purchase agreement is concluded when we accept the order and send the order confirmation, subject to successful payment and stock availability.

Please check the order confirmation and notify us promptly if any information is incorrect.

We may refuse or cancel an order when there is a legitimate reason, including:

  • the product is unavailable;

  • the displayed price or product information contains an obvious error;

  • payment cannot be authorised or appears fraudulent;

  • delivery to the supplied address is unavailable or unlawful;

  • the order breaches an applicable quantity limit; or

  • we reasonably suspect unlawful activity or unauthorised commercial resale.

If we cancel an order after payment has been received, we will refund the relevant amount using the original payment method.

  1. PAYMENT

Available payment methods are shown during checkout.

You must provide complete and accurate payment and billing information and be authorised to use the selected payment method.

Payment may be processed by Shopify Payments or another payment service provider. These providers may perform fraud prevention, security and identity checks in accordance with their own terms and privacy policies.

We do not store complete card details on our own systems.

  1. CANCELLING AN ORDER

If your order has not yet been fulfilled, you can request cancellation by contacting info@denieuwemarkt.com as soon as possible.

We cannot guarantee that an order can still be stopped after it has entered fulfilment. If the order has already been dispatched, you may exercise your statutory right of withdrawal after delivery in accordance with our Return and Refund Policy.

  1. SHIPPING AND DELIVERY

We deliver to the destinations and at the rates shown during checkout. Further information about processing times, delivery estimates, available destinations and collection from our store is provided in our Shipping Policy.

Delivery times are estimates unless we have expressly agreed a fixed delivery date. We will inform you if we become aware of a significant delay.

Unless another delivery period has been agreed, consumer orders will be delivered no later than 30 days after conclusion of the agreement, as required by applicable law.

We remain responsible for loss of or damage to an order until you, or a third party designated by you other than the carrier, physically receives it. This does not apply where you independently commissioned a carrier that was not offered by us.

Please provide a complete and accurate delivery address. Additional costs resulting from an incorrect or incomplete address supplied by the customer may be charged where permitted by law.

  1. STORE COLLECTION

When store collection is available, your order is ready only after you receive confirmation that it can be collected.

Please bring your order confirmation and, where reasonably required, proof of identity. If somebody else collects the order on your behalf, we may ask for confirmation that you authorised them to do so.

An online order collected from our store remains an online distance purchase when the purchase agreement was concluded online. The statutory right of withdrawal therefore remains applicable.

  1. RETURNS AND RIGHT OF WITHDRAWAL

Consumers generally have a statutory right to withdraw from an online purchase within 14 days after receiving it, without giving a reason.

The procedure, return address, applicable exceptions, return costs and refund conditions are described in our Return and Refund Policy. That policy forms part of these Terms.

Sale items, vintage and pre-loved items, artworks, consignment products and one-of-a-kind pieces are not automatically excluded from the statutory right of withdrawal.

Purchases made entirely in our physical store are not covered by the statutory cooling-off period. This does not affect your rights if a product is defective or does not conform to the agreement.

  1. DEFECTIVE OR NON-CONFORMING PRODUCTS

You are entitled to receive a product that conforms to the agreement and possesses the qualities you may reasonably expect, taking into account its description, price, age, condition and nature.

These statutory rights also apply to pre-loved, vintage and consignment products purchased from us. Normal signs of age or wear that were clearly disclosed before purchase are part of the agreed condition and are not defects.

If a product is defective, damaged, incomplete or different from what was agreed, contact us at info@denieuwemarkt.com. Depending on the circumstances and applicable law, you may be entitled to repair, replacement, a price reduction or termination of the purchase agreement.

Any commercial warranty offered by a manufacturer or maker is additional to, and does not replace or restrict, your statutory rights against us as the seller.

  1. ART, HANDMADE PRODUCTS AND CONSIGNMENT

Products made by artists and independent makers may naturally contain small variations resulting from materials or production methods. These variations are not defects when they are inherent to the product and consistent with its description.

Some products are sold by us on consignment. The fact that another party owns or produced an item before its sale does not change your contractual relationship with De Ploeg Retail B.V. We remain your point of contact for payment, delivery, returns and complaints.

Unless a product was made or modified specifically according to your personal instructions, the fact that it is handmade or unique does not by itself exclude the right of withdrawal.

  1. PROMOTIONS AND DISCOUNTS

Promotions, discount codes and special offers may be subject to additional conditions, validity periods, product exclusions or quantity limits.

Unless stated otherwise:

  • discount codes cannot be combined;

  • a discount cannot be applied retrospectively;

  • discounts have no cash value; and

  • a promotion applies only during the stated period and while stock lasts.

If specific promotional terms conflict with these Terms, the specific promotional terms apply to that promotion, provided they do not restrict mandatory consumer rights.

  1. GIFT CARDS

Gift cards may be subject to separate conditions stated when they are purchased or issued.

Gift cards cannot be exchanged for cash except where required by law. Loss, theft or unauthorised use should be reported to us promptly. Replacement is possible only where we can verify the original purchase and remaining balance.

Nothing in this section limits any statutory right that applies to the purchase of a gift card.

  1. WEBSITE USE

You may use our website only for lawful personal or commercial browsing and purchasing purposes.

You must not:

  • use the website for fraud or another unlawful purpose;

  • interfere with its security, availability or proper operation;

  • introduce viruses, malware or harmful code;

  • attempt to gain unauthorised access to accounts or systems;

  • collect personal data about other users without a lawful basis;

  • impersonate another person or provide deliberately false information;

  • reproduce or commercially exploit substantial parts of the website without permission; or

  • use automated systems in a way that places an unreasonable burden on the website or circumvents security measures.

We may restrict or suspend access where reasonably necessary to protect our website, customers or legal rights.

  1. INTELLECTUAL PROPERTY

Unless stated otherwise, the website and its content—including our branding, text, layout, graphics, photographs, videos and product presentation—are owned by or licensed to De Ploeg Retail B.V.

Certain images, artworks, designs and other materials remain the intellectual property of the relevant artists, designers, photographers, brands or contributors.

You may view and use the website for personal purposes. You may not reproduce, alter, distribute, sell, publish or commercially exploit its content without prior permission from the relevant rights holder.

Purchasing an artwork, print, design object or other product does not transfer copyright or other intellectual property rights unless expressly agreed in writing.

  1. REVIEWS AND SUBMITTED CONTENT

If you submit a review, photograph, comment or other content, you confirm that:

  • you created it or have permission to submit it;

  • it does not infringe another person’s rights;

  • it is not unlawful, misleading, discriminatory, threatening or defamatory; and

  • it does not contain malware, spam or undisclosed advertising.

You grant us a non-exclusive, worldwide and royalty-free licence to display, reproduce and use submitted content in connection with operating and promoting De Nieuwe Markt. You retain ownership of your content.

We may remove submitted content where we have a legitimate reason to do so, including where it is unlawful, irrelevant, fraudulent or violates these Terms.

  1. THIRD-PARTY SERVICES AND LINKS

Our website may contain links to third-party websites or use services provided by payment providers, delivery companies, social-media platforms and other partners.

We are not responsible for the content or availability of independent third-party websites. Your use of their websites or services may be governed by their own terms and privacy policies.

This does not exclude our responsibility for third parties we engage to perform our own contractual obligations, such as delivery of your order.

  1. RELATIONSHIP WITH SHOPIFY

Our online store is powered by Shopify, which provides the ecommerce technology that enables us to offer the website and related services.

All purchases through our store are made directly from De Ploeg Retail B.V., trading as De Nieuwe Markt. Shopify is not the seller of our products and is not responsible for fulfilling your order or providing customer service for your purchase.

Certain personal data may be processed by Shopify to provide and secure the online store, as explained in our Privacy Policy and Shopify’s applicable privacy information.

  1. PRIVACY

We process personal data in accordance with our Privacy Policy and applicable data protection law.

Our Privacy Policy explains what information we collect, why we use it, how long we retain it, with whom it may be shared and what rights you have.

  1. AVAILABILITY OF THE WEBSITE

We aim to keep the website available and functioning correctly, but we cannot guarantee uninterrupted or error-free access.

We may temporarily suspend or restrict parts of the website for maintenance, security, technical problems or circumstances outside our reasonable control. Where practical, we will try to minimise disruption.

Temporary unavailability of the website does not affect orders that we have already accepted.

  1. LIABILITY

Nothing in these Terms excludes or restricts liability where doing so would be unlawful. In particular, these Terms do not restrict:

  • your mandatory consumer rights;

  • our liability for intent or deliberate recklessness;

  • liability for death or personal injury caused by negligence;

  • liability for supplying defective or non-conforming products; or

  • any other liability that cannot legally be excluded.

Subject to the above, we are not liable for indirect or consequential losses that were not reasonably foreseeable when the agreement was concluded and that are not attributable to a breach by us.

We are not responsible for damage caused by improper, unsafe or unintended use of a product, failure to follow supplied instructions, normal wear and tear or unauthorised alteration of a product.

Nothing in this section affects remedies available to consumers under mandatory Dutch or European law.

  1. EVENTS OUTSIDE OUR CONTROL

We are not responsible for a delay or failure caused by circumstances beyond our reasonable control, such as severe weather, natural disasters, strikes, transport disruption, government measures, power failures, telecommunications failures or other comparable events.

We will take reasonable steps to limit the consequences and resume performance as soon as reasonably possible.

Mandatory rights concerning delivery, cancellation and refunds remain applicable.

  1. COMPLAINTS

If you have a complaint, contact us at info@denieuwemarkt.com and include your order number and a clear description of the issue.

We will acknowledge and handle complaints within a reasonable period and will try to find an appropriate solution.

If we cannot resolve a consumer complaint together, you may use the dispute resolution options available under applicable Dutch and European consumer law or submit the matter to a competent court.

  1. GOVERNING LAW AND JURISDICTION

These Terms and all purchase agreements with De Ploeg Retail B.V. are governed by Dutch law.

If you are a consumer living outside the Netherlands, this choice of law does not deprive you of mandatory protection granted by the law of your country of residence where that protection applies.

Disputes may be submitted to the competent Dutch court. Consumers may also bring proceedings before another court that has jurisdiction under mandatory consumer law.

  1. CHANGES TO THESE TERMS

We may update these Terms when our services, business practices or legal obligations change.

The version that applied when you placed an order continues to govern that order. Updated Terms apply to future use and future orders from the date on which they are published.

The most recent version is always available on our website.

  1. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in effect.

The invalid provision will be interpreted or replaced, where legally possible, in a way that most closely reflects its original purpose while complying with applicable law.
